1. Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the PEPfluent platform ("PEPfluent," "we," "us," or "our"), available at pepfluent.com and related subdomains (the "Service"). By creating an account, registering a child, joining through a school, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you are creating or managing an account on behalf of a child, you confirm that you are that child's parent or legal guardian and that you have the authority to accept these Terms for both yourself and the child.
2. Description of the Service
PEPfluent helps students in Grades 4 through 6 in Jamaica prepare for the Primary Exit Profile (PEP) examinations. The Service includes diagnostic assessments, practice questions across Mathematics, Language Arts, Science, Social Studies, and (for Grade 6) Ability/Reasoning, progress tracking by topic and subject, and reporting tools for parents, teachers, principals, and school administrators.
PEPfluent is an independent test-preparation platform. We are not affiliated with, endorsed by, or acting on behalf of Jamaica's Ministry of Education, Youth and Information, or any examining body responsible for the PEP. References to PEP topics, formats, or scope are based on publicly available curriculum guides and our own research, and do not guarantee alignment with any future, unreleased, or modified version of the examination.
3. Eligibility and Accounts
The Service is intended for use by:
- Parents and guardians, who register and manage accounts for their own children;
- Children (students), who use a student account created and supervised by a parent or guardian, or provisioned through their school;
- Teachers, principals, and school administrators, who access student progress within their own school under permissions granted by their school or by PEPfluent; and
- Platform administrators, who manage the Service on behalf of PEPfluent.
An adult creating an account must be at least 18 years old and capable of entering a binding contract. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it up to date. We may suspend or terminate an account that we reasonably believe is fraudulent, shared in violation of these Terms, or being used to gain unauthorized access to another person's data.
4. Children's Accounts and Parental Responsibility
A child does not create their own PEPfluent account. A student account is created either by a parent or guardian directly, or by a school on behalf of enrolled students, after which a parent or guardian links to and manages that account.
By creating or linking a student account, you confirm that you are the child's parent or legal guardian, or that you are a school official authorized by the child's parent or guardian and by the school to create the account. Parents and guardians are responsible for supervising their child's use of the Service, for the accuracy of information provided about their child, and for reviewing our Privacy Policy, which explains what information we collect from children and how it is used.
A parent or guardian may deactivate a child's account, or request that PEPfluent delete it, at any time by contacting us at the email address in Section 15. A child's account may also be deactivated automatically if the primary guardian's account is deactivated, as described in our Privacy Policy.
5. Schools, Educators and Administrators
A school may join PEPfluent through an authorized principal or administrator, who may invite teachers and other staff, and who may issue a join code that allows parents at that school to register their children under the school's account. A school's principal and administrators are responsible for the accuracy of information they provide about their school and for the conduct of staff accounts they create or approve.
Teachers and school staff may access student information only for students properly associated with their own school or class, and only for the purpose of supporting that student's learning. Staff access does not extend to billing, payment, or account information belonging to a student's family, which remains visible only to PEPfluent and the family itself.
If a school's account is deactivated, staff accounts associated with that school lose access to the Service. Deactivating a school does not affect the accounts of students or their families, who continue to have access to their own data independent of the school.
6. Fees, Early Access and Future Payment
PEPfluent is currently offered free of charge during an early-access period, including full access to diagnostic assessments and practice content. We do not currently process online payments.
We intend to introduce paid subscription plans in the future, including a standard annual rate and a reduced rate for students at partner schools. When paid plans are introduced:
- Pricing will be clearly displayed before you are asked to pay;
- Existing accounts will be given reasonable advance notice before any free features become paid;
- Payment will be processed through a third-party payment processor, and PEPfluent does not store your full card or bank account details; and
- These Terms will be updated to include the applicable payment, refund, and cancellation terms, and continued use of paid features after that update will constitute acceptance of those terms.
Until paid plans are introduced, any reference in the Service to a price or a plan is informational and does not create a payment obligation.
7. Sponsorships
PEPfluent allows a third party (a "sponsor") to pay for access on behalf of a specific student or a group of students at a school, using a link provided by that student's guardian or by the school. A sponsor never receives a PEPfluent login and never gains access to a student's practice activity, answers, or detailed progress.
What a sponsor can see depends entirely on the consent given by the student's guardian at the time the sponsorship link is created:
- If the guardian has chosen to share progress, a sponsor may see a first name, grade, school, and a high-level summary of subject-tier progress.
- If the guardian has not chosen to share progress, a sponsor sees only that a sponsorship has funded access, with no name or individual progress shown.
- A school-level sponsorship link shows only aggregate, anonymized figures (for example, how many seats are funded), never any individual child's name or data.
Sponsorship payments are one-time and do not create any ongoing relationship, access right, or decision-making authority over the sponsored student's account.
8. Acceptable Use
You agree not to:
- Use the Service for any purpose other than supporting a child's education and exam preparation;
- Create an account using false information, or impersonate another person, school, or organization;
- Share login credentials in a way that allows someone other than the intended account holder to access the Service;
- Attempt to access another family's, student's, or school's data without authorization;
- Attempt to probe, scan, or test the security of the Service, or to circumvent any access control, rate limit, or content protection;
- Copy, scrape, reproduce, or redistribute PEPfluent's questions, answer keys, explanations, or other content outside the Service, or use them to train another product;
- Upload or transmit any content that is unlawful, harmful, or inappropriate for a school-facing platform used by children; or
- Interfere with or disrupt the Service, including through excessive automated requests.
We may suspend or terminate access for any account that violates this section, as described in Section 12.
9. Content and Intellectual Property
All questions, explanations, diagnostic reports, software, branding, and other materials made available through the Service (the "Content") are owned by PEPfluent or its licensors and are protected by copyright and other intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Content solely for personal, non-commercial educational use within the Service.
You retain ownership of any information you submit about yourself or your child (such as a profile, a topic suggestion, or a support message). By submitting it, you grant PEPfluent a license to use it to operate, maintain, and improve the Service, consistent with our Privacy Policy.
All trademarks, logos, and the PEPfluent name are our property. Nothing in these Terms grants you any right to use them without our prior written consent.
10. Educational Disclaimer
PEPfluent is a study and practice tool. It is designed to support a student's preparation for the PEP examinations, not to replace classroom instruction, a teacher's judgment, or official guidance from a student's school or the Ministry of Education. We do not guarantee any particular score, grade, or examination outcome, and performance within PEPfluent is not a prediction or assurance of performance on the actual PEP examination.
Content is reviewed for accuracy before publication, but PEPfluent does not warrant that every question, answer, or explanation is free of error. If you believe a question or answer is incorrect, please report it using the in-app feedback option or by contacting us.
11. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, PEPfluent and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the total amount, if any, that you paid to PEPfluent in the twelve months preceding the claim.
Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or a breach of statutory obligations relating to children's data.
12. Suspension and Termination
A parent or guardian may deactivate their own account, or a linked child's account, at any time by contacting us. A school may be deactivated by PEPfluent at the school's request or for non-payment, safeguarding concerns, or other reasons; deactivating a school affects that school's staff accounts only, not the accounts of its students and families.
We may suspend or terminate any account that violates these Terms, poses a safeguarding risk to a child, or is used fraudulently or abusively. Where reasonably possible, we will provide notice before taking this step. Upon termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive termination (including Sections 9, 10, 11, and 14) will continue to apply.
13. Changes to These Terms
We may update these Terms from time to time, including when we introduce paid plans. If we make a material change, we will provide reasonable advance notice, such as an email to the address on your account or a notice within the Service, before the change takes effect. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to a change, you should stop using the Service and may deactivate your account.
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles, without prejudice to any mandatory consumer-protection or data-protection rights you may have under the laws of Jamaica as the jurisdiction in which the Service is primarily used. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, except where applicable law requires otherwise.
